THE DISPATCH
The regulator that polices US derivatives has never held a formal meeting on AI agents. Yesterday it held its first.
The Event
The CFTC convened its Frontier Forum on October 28, 2026 in Washington. Chairman Michael S. Selig gave the keynote.
The agenda appeared on October 20 in Press Release 9312-26. Two panels, one unanswered question.
Panel one covered AI in derivatives markets generally. Panel two covered agentic trading specifically.
The second one is the reason this matters. Do CFTC rules apply when an AI agent runs the trade?
No rule was proposed. No vote was taken.
The agency called it a listening session. Selig said the goal was to “engage directly with the people building” these tools.
That framing is itself the signal. The regulator is in learn mode.
Why It Shifts Territory
The question is overdue by a wide margin. Industry data indicates AI agents already drive the majority of crypto trading volume globally.
On some decentralised venues, estimates run far higher still. Automated flow dominates to the point where human orders are the exception.
Equities tell the same story on a longer timeline. Algorithmic execution has made up the bulk of volume for years.
Futures markets are not far behind either. This is not a forward-looking problem.
Now the regulatory position. The CFTC has issued exactly one piece of AI guidance.
Staff Advisory Letter 24-17, dated December 5, 2024. It reminded firms their existing duties still apply when they use AI.
It said nothing about the AI being the trader. That distinction is the whole gap.
A tool used by a registered person is covered by that person’s obligations. An agent acting on its own is not clearly covered by anything.
Musk's $119 billion project could send THIS stock soaring
Get In Before November 11th
In May, a Texas county filing revealed plans for Musk’s $119 billion Terafab chip plant.
It could signal the next phase of AI…
One The Wall Street Journal calls “A Massive New Shift in AI Computing.”
If you missed big gains on Tesla or Nvidia, this could be your second chance…
Because one little-known company (not Tesla or SpaceX) holds 150 patents on the technology at the center of this new kind of AI.
This company’s patented tech can produce intelligence 1,000X faster than regular AI.
And it’s about the size Nvidia was when I recommended it in 2016…
Before its 37,800% run…
Which could have turned $5,000 into $1,895,000.
If history repeats itself, this single stock could be enough help fund your whole retirement.
But you must get a stake before November 11…
As I believe this company is just days away from announcing its biggest deal ever.
before November 11.
P.S. The company has a $24 billion backlog and is sold out into 2027, I haven’t seen a setup like this for years. Get the details before November 11.
The Registration Question
Here is the specific hole, and it is not abstract.
Under the Commodity Exchange Act, anyone advising others on futures must register with the CFTC. Commodity trading advisors carry disclosure, recordkeeping and fitness obligations.
Now suppose an AI agent gives that same advice. Does it trigger registration?
Nobody knows. The statute was written for people and firms, not software acting without a human in the decision.
Three answers are possible and each has consequences. The agent’s operator registers, which puts a named firm on the hook.
Or the agent is treated as a tool, which means the user carries the duty. Or it falls outside the perimeter entirely, which is the outcome nobody will defend in public.
The agency has not picked one. Until it does, the product teams pick for themselves.
Who Is In The Room
Read the panel list, because it says more than the agenda does.
The forum seated the heads of Ornn, Architect and Liquid Compute. Greg Xethalis of Multicoin Capital ran it.
Session two was led by Katherine Kirkpatrick Bos of Chainlink Labs. These are crypto and AI firms.
Not legacy dealers. Not the large banks that dominate cleared futures.
That composition tells you who the agency thinks is building this. It also tells you whose framing will shape the first draft of any rule.
Meanwhile the industry stopped waiting. Six banks published shared rules for agentic commerce on September 22.
Bank of America, Capital One, ING, NatWest, ASB Bank and Commonwealth Bank. Those rules bind nobody.
But they exist, and the CFTC’s do not. Private standards fill the space a regulator leaves empty, and they are hard to unwind later.
Nvidia just bet $7 billion on a new type of AI
Here’s how to profit..
While pundits on CNBC and Fox Business argued about the “AI bubble” for most of the year…
Nvidia invested more than $7 billion into a radical “light-speed” device…
That’s about to shatter the limitations of AI as we know it…
Bill Gates put more than $200 million of his own money into it…
And BlackRock, Vanguard, Morgan Stanley, even Norway’s trillion-dollar sovereign wealth fund, are all moving money to prepare for what’s coming.
Already, stocks involved with this “light-speed” device are breaking out 133%, 217%, even 320%…
But it’s just getting started.
In fact, Wall Street insider Jason Bodner — the same man who called Nvidia at $4.50 — says this radical device is about to launch a whole new wave of AI winners…
And to prove it, he’s giving away his #1 stock involved with it — for free.
(No purchase necessary.)
Jason also flagged 10 popular AI stocks he believes will get crushed once this radical device goes mainstream. Click here to get the full list before it’s too late..
Scoreboard
This touches crossover moves, metric five. It marks the first formal CFTC engagement on agentic trading.
Direction is neutral to positive for the machines. A door opened and no lines were drawn.
The absence is the story. Rules take years, and the volume arrived already.
Note the contrast with the week’s other news. Four large US banks blocked outside AI agents from customer accounts through contract terms, not regulation.
Private rules are moving faster than public ones in both directions. Some firms are writing permissions, others are writing prohibitions.
Watch for a concept release or a request for comment. That is the next formal step and the first one with a docket attached.
Watch the registration question specifically. Whichever answer the agency lands on reprices every agentic trading product in the US.
Watch who shows up to the second forum. If the large clearing members appear, the drafting fight has started.
Territory
Territory: +machines on the gap.
Agentic trading operates under a 2024 advisory written for human firms using tools, and nothing has replaced it.
